What Happened
The Supreme Court has begun its new term, with a docket filled with major cases that could impact the Trump administration's agenda and the court's own legitimacy.
According to reports from The Hill and Fox News, the court will hear cases on executive power, gun rights, religious liberty, and voting rules, among other issues.
The term begins at a time when the court's public approval stands near record lows, with a Washington Post/Ipsos poll in July finding that 46% of Americans think the justices rule on Trump administration policies based on their political views, while just 25% see the court as ruling based on the law.
Gallup's July poll showed the Supreme Court's job approval slumped to a record low of 33%, with a record high 61% disapproval, driven by a steep drop in Republicans' backing of the court since last year.
What the Evidence Establishes
The evidence suggests that the Supreme Court's relationship with the Trump administration is strained, with the president himself criticizing the court's decisions and the justices facing increased threats and intimidation.
According to Fox News, several federal judges have reported budget shortfalls compromising their physical security, with the U-S Marshals reporting 370 threats made to federal judges as of July 1, a 31% year-over-year increase.
Justice Elena Kagan told a congressional panel in July that criticism of the court is fair game, but intimidation is a different thing entirely, and that when political figures try to intimidate judges and justices, it crosses a line.
Justice Barrett has also spoken out about the threats she has faced, including wearing a bulletproof vest away from the court and being a victim of a swatting incident at her home.
Where the Accounts Conflict
There are conflicting accounts about the Supreme Court's motivations and the impact of its decisions on the Trump administration's agenda.
Some, like former Deputy Assistant Attorney General John Yoo, argue that the court is facing constitutional challenges surrounding birthright citizenship and executive authority under the 14th Amendment.
Others, like House Democratic Leader Hakeem Jeffries, argue that dramatic Supreme Court reform is necessary, with proposals including 18-year term limits for the justices, expanding the number on the bench, and an independently-enforced code of ethics.
The court's own justices, like Chief Justice John Roberts, have defended the court against accusations of partisanship, with Roberts saying that the court is not simply part of the political process and that there is a reason for that.
Context and Stakes
The Supreme Court's new term comes at a critical time, with the midterm elections approaching and the court's decisions potentially impacting the outcome.
The court's legitimacy is also at stake, with the public's perception of the court's motivations and the impact of its decisions on the Trump administration's agenda.
According to legal analyst Thomas Dupree, the court's new term will feature major cases concerning the relationship among the three branches of the federal government and the relationships between the federal government and the states.
Dupree also notes that the court will likely hear election-related cases about the right to vote, how to protect it, and how to ensure the integrity of elections.
What to Watch Next
As the Supreme Court's new term progresses, there are several key cases and developments to watch, including the court's decisions on executive power, gun rights, and voting rules.
The court's handling of emergency disputes, such as those related to the midterm elections, will also be closely watched.
Additionally, the possibility of a Supreme Court vacancy in coming months, with speculation centered on 76-year-old Justice Samuel Alito, could significantly impact the court's decisions and the Trump administration's agenda.
According to sources close to Alito, considerations of his future are driven more by personal practicality rather than politics, with Alito planning to stay on for another term.
Bottom Line
The Supreme Court's new term will be marked by high-profile cases and intense scrutiny, with the court's legitimacy and the Trump administration's agenda hanging in the balance.
The court's decisions will have significant implications for the country, from the relationship between the branches of government to the integrity of elections.
As the court navigates these complex issues, it will be essential to watch for developments and analyze the implications of the court's decisions.
Ultimately, the Supreme Court's new term will be a critical period for the country, with the potential to shape the course of American history for years to come.
