What Happened
A federal magistrate judge, U.S. Magistrate Judge Zia M. Faruqui, criticized the Justice Department (DOJ) during a hearing on Tuesday for attempting to add new charges against two former FBI officials, Nikki Floris and Bradley Benavides, accused of lying to Congress about their knowledge regarding the federal investigation into Hunter Biden's laptop ahead of the 2020 election.
The DOJ filed a superseding criminal complaint seeking to add new felony obstruction allegations against the former officials, but the judge rejected it due to lack of judicial authorization.
The original complaint alleged that Floris and Benavides had misrepresented their involvement in investigations concerning former President Joe Biden's son, Hunter Biden, in statements to Congress.
What the Evidence Establishes
The evidence establishes that the DOJ attempted to add new charges against the former FBI officials without first securing judicial approval, which the judge deemed inappropriate and harmful to the defendants.
The superseding complaint sought to add felony obstruction allegations against Floris and Benavides, while softening some of the language used to describe their involvement in the Hunter Biden investigations.
However, the judge rejected the superseding complaint, allowing the preliminary hearing to proceed on the original allegations that Floris and Benavides lied to Congress.
The judge's decision was based on the fact that the DOJ had not secured the required judicial authorization for the new charges, and that the filing of an unsigned and unsworn complaint in the middle of the night was unprecedented and potentially harmful to the defendants.
Where the Accounts Conflict
The accounts of the DOJ and the defense teams of Floris and Benavides conflict regarding the timing and content of the charges.
The defense teams argue that the charges are meant to engineer publicity and that the timing of the charges, just days before the midterm elections, is suspicious.
The DOJ, on the other hand, maintains that the charges are based on the evidence and that the timing is coincidental.
Additionally, the judge's criticism of the DOJ's handling of the case has been met with criticism from conservatives, who argue that the judge has a history of supporting diversity, equity, and inclusion initiatives and has been critical of Immigration and Customs Enforcement (ICE).
Context and Stakes
The context of the case is that the Hunter Biden investigation has been a highly politicized and controversial issue, with many Republicans accusing the Biden administration of covering up wrongdoing by the former president's son.
The stakes of the case are high, as a conviction of the former FBI officials could be seen as a victory for the Biden administration and a vindication of their handling of the investigation.
On the other hand, an acquittal or a dismissal of the charges could be seen as a blow to the administration's credibility and a validation of the claims of wrongdoing by the former FBI officials.
The case also has implications for the upcoming midterm elections, as the timing of the charges has been criticized as an attempt to influence the outcome of the elections.
What to Watch Next
The next step in the case will be the preliminary hearing, which will proceed on the original allegations that Floris and Benavides lied to Congress.
The hearing will determine whether there is probable cause to believe that the former FBI officials committed the alleged crimes.
Additionally, the defense teams of Floris and Benavides may file motions to dismiss the charges or to suppress evidence, which could potentially impact the outcome of the case.
The DOJ may also appeal the judge's decision to reject the superseding complaint, which could lead to further delays and complications in the case.
Bottom Line
In conclusion, the judge's criticism of the DOJ's handling of the case highlights the complexities and controversies surrounding the Hunter Biden investigation.
The case has significant implications for the Biden administration, the FBI, and the upcoming midterm elections.
The outcome of the case will depend on the evidence presented at the preliminary hearing and the subsequent trial, and it remains to be seen whether the former FBI officials will be convicted or acquitted of the alleged crimes.
The case serves as a reminder of the importance of judicial oversight and the need for transparency and accountability in the handling of high-profile investigations.

It's interesting that Judge Faruqui is speaking out against the DOJ's handling of these charges, given the timing of the superseding criminal information filing just ahead of the 2024 election cycle.
